Google accused of illegally collecting data through its Gemini AI assistant
A lawsuit has been filed in California federal court against Google, accusing the company of secretly collecting data. According to the plaintiffs, the Gemini artificial intelligence was automatically activated to access private message histories in Gmail, Chat, and Meet without users' knowledge.
According to the lawsuit, users of Gmail, Chat, and Meet were previously able to voluntarily activate the artificial intelligence feature. However, in October, the Alphabet Inc. subsidiary allegedly unilaterally and without proper notice enabled Gemini for all of these apps. This, according to the plaintiffs, allowed the system to collect personal data without the explicit knowledge or consent of users.
The lawsuit notes that while the company provides the option to disable Gemini, doing so requires manually changing the relevant privacy settings. If the user fails to do so, the system allegedly continues to have access to the entire personal message history, including every email sent, received, and attachment in the Gmail account.
The plaintiffs allege that Google's actions violate the California Invasion of Privacy Act. This law, passed in 1967, prohibits the secret eavesdropping and recording of private communications without the consent of all parties involved. The lawsuit was filed in federal court in San Jose, California.
