Elon Musk has filed a lawsuit against OpenAI and Microsoft, seeking up to $134 billion in damages. He claims this amount represents "unjustified profits" the companies received thanks to his early support and contributions to the startup's development.

In a federal court filing, Musk estimated his early financial support for OpenAI since 2015 at between $65.5 billion and $109.4 billion. He estimated Microsoft's contribution at between $13.3 billion and $25.1 billion. He claims to have personally contributed approximately $38 million, representing approximately 60% of the initial funding, and also assisted with hiring and attracting key partners.

OpenAI responded by calling the lawsuit baseless and part of Musk's harassment campaign. A Microsoft spokesperson claimed there was no evidence that the company provided improper support to OpenAI. Both companies contested the compensation claims and asked the court to limit the testimony of Musk's expert, financial economist C. Paul Vazzana, calling his analysis fictitious and unverifiable.

The lawsuit's central argument is that OpenAI violated its original nonprofit mission by transforming itself into a for-profit organization. Musk, who left the company in 2018 and now leads the competing xAI project, asserts his right to compensation, comparing his role to that of an investor in the startup.

The case will be tried by a jury. The trial is expected in April. If the companies are found guilty, Musk could seek not only monetary compensation but also other sanctions, including a possible injunction.
